Terms of Service

Please read these Terms of Service carefully before using the EFISCharts website or subscribing to any EFISCharts service. By accessing our website or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Parties and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "Subscriber") and Abeam LLC, a limited liability company doing business as EFISCharts ("EFISCharts," "we," "us," or "our"). These Terms govern your access to and use of our website at efischarts.com, our EFISChartSync desktop application, and any related services (collectively, the "Services").

2. Description of Services

EFISCharts provides subscription-based access to FAA aeronautical chart data formatted for use with Dynon SkyView, Dynon D-series, and Advanced Flight Systems (AFS) EFIS avionics systems. Services include:

• Access to the EFISChartSync application for downloading and managing chart data
• Current FAA chart data updated on each 28-day AIRAC cycle, including sectional charts, terminal area charts (TACs), IFR enroute charts, instrument approach plates, SIDs, STARs, airport diagrams, and chart insets, as applicable to your subscription tier
• A permanent activation code tied to your Dynon or AFS serial number

We reserve the right to modify, add, or discontinue any feature of the Services at any time with reasonable notice.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use our Services. By using the Services, you represent and warrant that you meet these requirements. The Services are intended for use by licensed pilots and aviation enthusiasts operating aircraft with compatible avionics systems.

4. Accounts and Activation Codes

Upon subscribing, you will receive a permanent activation code tied to the Dynon or AFS serial number you provide at checkout. You are responsible for:

• Providing accurate serial number information at the time of purchase
• Keeping your activation code confidential
• All activity that occurs under your activation code

Activation codes are issued per aircraft or per subscriber account and may not be shared or transferred without our written consent. If you believe your activation code has been compromised, contact us immediately through our support page.

5. Subscriptions and Billing

Subscription Plans. We offer annual subscription plans as described on our pricing page. Current plan details and pricing are incorporated into these Terms by reference.

Free Trial. New subscribers may be offered a free trial period. No charge is made during the trial. At the end of the trial period, your subscription will automatically convert to a paid annual subscription unless you cancel before the trial ends.

Billing. Annual subscriptions are billed in advance for each subscription year. Payment is processed through our third-party payment processor. By providing payment information, you authorize us to charge the applicable subscription fee.

Auto-Renewal. Subscriptions automatically renew at the end of each subscription year at the then-current rate unless you cancel before the renewal date. We will notify you before any price changes take effect.

Cancellation. You may cancel your subscription at any time through your account or by contacting us. Cancellation takes effect at the end of your current paid period. We do not offer prorated refunds for partial subscription periods, except where required by applicable law.

Refunds. If you are dissatisfied with the Services within the first 30 days of a paid subscription (not a trial), contact us and we will evaluate your request in good faith. We reserve the right to decline refund requests after 30 days.

Price Changes. We reserve the right to adjust subscription pricing. We will provide at least 30 days' notice of any price increase before your next renewal date.

6. License Grant

Subject to your compliance with these Terms and payment of applicable fees, EFISCharts grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the EFISChartSync application on computers and devices you own or control
• Download, store, and display the chart data on the number of USB devices and avionics systems associated with your subscription

This license is for your personal, non-commercial use in connection with your own aircraft operations. The license terminates automatically upon expiration or cancellation of your subscription.

7. Restrictions

You agree not to:

• Share, distribute, resell, sublicense, or transfer chart data or activation codes to any third party
• Use the chart data for commercial redistribution or in any product or service offered to third parties
• Reverse engineer, decompile, or disassemble the EFISChartSync application
• Use the Services in any way that violates applicable law or regulation
• Circumvent any technical measures used to protect or limit access to the Services
• Use automated means to access or download chart data beyond the functionality provided by the EFISChartSync application

8. Intellectual Property

The EFISChartSync application, our website, and all associated software, designs, and content are owned by Abeam LLC and protected by applicable intellectual property laws. The underlying FAA aeronautical chart data is published by the Federal Aviation Administration and is in the public domain; however, our formatting, processing, georeferencing, and delivery infrastructure are proprietary.

Nothing in these Terms transfers any ownership rights to you. The "EFISCharts" name, logo, and related marks are trademarks of Abeam LLC.

9. Aviation Data Disclaimer

Chart data provided through EFISCharts is derived from official FAA publications and is updated on each AIRAC cycle. However:

• Not for primary navigation. The chart data and EFISChartSync application are not certified avionics and are not approved for use as the primary or sole navigation reference. They are supplemental tools only.
• Currency verification. Always verify that chart data is current before flight. AIRAC cycle dates are displayed in the EFISChartSync application. It is your responsibility to ensure that current charts are loaded before each flight.
• No guarantee of accuracy. While we take care to accurately process and deliver FAA chart data, we cannot guarantee that the data is free from processing errors, transmission errors, or display anomalies on all avionics configurations.
• Pilot in Command responsibility. You, as Pilot in Command, are solely responsible for safe operation of your aircraft and all flight decisions. Use of our Services does not relieve you of any duty imposed by applicable aviation regulations.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ABEAM LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ABEAM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT SHALL ABEAM LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO EFISCHARTS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Abeam LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any claim that your use of the chart data caused harm to a third party.

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time if we have reason to believe you have violated these Terms. Upon termination, your license to use the Services and any downloaded chart data ceases immediately. Sections 8, 9, 10, 11, 12, and 15 survive termination of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and notify active subscribers by email at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the effective date.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Abeam LLC is organized, without regard to conflict of law principles. Any dispute arising under these Terms that cannot be resolved informally shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
